"Belskiy and partners" lawyers have won the refusal to satisfy claims for bringing to subsidiary liability for the ex-CEO of Kira Plastinina
The client, Jan Heere, former CEO of KP Style and KP Design, was represented by a team of lawyers led by Anna Shalneva, partner of Belsky & Partners, and Konstantin Shorygin, a junior partner of the firm.

The insolvency administrator attempted to sue a client for subsidiary liability during the arbitration process. In the trial court and on appeal, the court upheld the application of the insolvency administrator and brought the Client to subsidiary liability for an amount of over 900 million rubles.

The Arbitration Court of the Moscow District was overturned the court’s decision and sent it back for a fresh review to the court of first instance, as a result of Belskiy and Partners lawyers work. The defense argued that Jan Heere's actions were not the cause of the company's bankruptcy. The company's tax debt, which played a significant role in its bankruptcy, existed before the client took office. The Client has already taken over the company, which is already in a bad financial state. Furthermore, during his time as CEO, he took all necessary management decisions to minimize any negative consequences.

The Moscow Arbitration Court supported the arguments of Belsky and Partners lawyers and refused to satisfy claims for bringing to subsidiary liability the CEO in January 2025. According to the Court, the debtor's insolvency cannot be established by the company's solvency ratios.

Jan Heere is a prominent manager in the retail industry worldwide. He held the position of director of international development at Marks & Spencer and directed Inditex's expansion to the Russian and CIS markets (Zara Home, Massimo Dutti, Bershka, Oysho, Pull & Bear, Stradivarius, Uterqüe).
