Moscow City Court has released the co-founder of First Mortgage Company from the pre-trial detention centre for the second time
Alexander Verkhoturov is accompanied by Olga Kubantseva, the junior partner of “Belskiy and Partners”.

Verhoturov was detained on charges of fraud in the amount of 160 million rubles during the issuance of micro-loans secured on dwellings. The Moscow City Court later declined the Investigative Сommittee's request to extend the Client's detention and transferred him under a ban on certain actions.

The Prosecutor's office and victims appealed this decision because half of them were not informed of the hearing. Due to the opportunity to escape, the Investigative Сommittee requested that the Client be sent to pre-trial detention for further detention.

The lawyer of the accused Olga Kubantseva called these arguments untenable because the foreign passports were taken during the search of Verhoturov at the beginning of the investigation. The Client, who had numerous chances to escape, did not realize any of them over a month and a half after his release.

He did not escape either before the appeal or during the reconsideration by the Moscow Court of the motion for extension of his arrest. It took three days - 23, 24 and 25 of May. And all these days, the accused has come to court with things, ready for a new arrest. The lawyer maintains that civil court decisions in which her client defends his position are not seen as a threat to victims. She noted that the investigation is completed and Verkhoturov has been regularly reviewing 95 volumes of the case since the 2 of March. 45 volumes have already been studied by the defendant.

Lawyer requested to dismiss the motion for investigation and impose other forms of restraint on her client that are not connected to detention, such as house arrest and the prohibition of certain actions.

The judge of the Moscow City Court supported the position of the defense, because the investigators did not provide convincing evidence that the person involved would hide and that he was delaying the examination of the case.
The judge considered «unconvincing» reason for detention of the client having a passport and citizenship of another country.
