The Management of a Metallurgical Company has been protected by Belskiy and Partners from accusations by the Investigative Committee of the Russian Federation
Partners of the bureau, Kirill Belskiy and Kristina Malekina, accompanied the management of a metallurgical company (The Forbes 100 most profitable companies in 2024) in the context of a criminal case concerning an accident during the logistics of workers to the production site.

Several employees died and were injured in a car accident that happened at the company's quarry in 2024. The Territorial Investigative Department of the Investigative Committee of the Russian Federation initiated a criminal case under p. 3 art. 238 of the Criminal Code of the Russian Federation (provision of services that do not meet safety requirements), as well as p. 5 art. 264 of the Criminal Code of the Russian Federation (traffic violation and violation of vehicle operating rules). There were risks of bringing the General Director and other top managers of the company to criminal liability, as the accident occurred during logistics services, because the structure of art. 238 of the Criminal Code of the Russian Federation provides for the possibility of holding top management and the General Director liable in case of violations of safety requirements detected.

Attorney investigation was conducted by the bureau lawyers, which included interviews with dozens of employees and an analysis of the system of cascading of responsibility. The lawyers were able to prove to the investigation that in this case there is no elements of art. 238 of the Criminal Code of the Russian Federation, due to services were provided in the B2B sector, so employees were not considered consumers in this case. The lawyers also have been able to prove, based on local acts, that the company has a complex structure and that its managers fundamentally cannot be considered as suspects in the crime, as they are not responsible for the logistic process technical safety.

As a result of the work, it was possible to reclassify the case to p. 3 art. 109 of the Criminal Code of the Russian Federation (causing death through recklessness), and p. 2 art. 118 of the Criminal Code of the Russian Federation (causing serious bodily harm through recklessness), that has significantly reduced the risks of top management.

Due to the comprehensive work of lawyers with various participants in the proceedings, the case was settled by conciliation between the parties under art. 118 and minimize the penalties under art. 109 of the Criminal Code of the Russian Federation. The accident perpetrator's immediate supervisor was given a suspended sentence.
